What is The Domestic Hemp Production Program
On the 29th of October, 2019, the USDA Secretary, Sonny Perdue, announced that his team has had an all-hands-on-deck approach and that they are excited to announce the establishment of the U.S. Domestic Hemp Production Program. The program creates a consistent set of regulations surrounding hemp production throughout the United States.
“At USDA, we are always excited when there are new economic opportunities for our farmers, and we hope the ability to grow hemp will pave the way for new products and markets,” said Secretary Perdue.*
The interim final rule will become effective once it is published in the Federal Register. Once the interim final rule becomes effective, the USDA will invite the general public for commentary, and a preview will be made on their website.
In addition to the interim final rule, the USDA also has detailed guidelines for the sampling and testing of the hemp to ensure that no more than 1 percent of the plants in a specific lot would exceed the acceptable THC limit, disposing of any that would not be in compliance with the requirements.
Furthermore, the fact that hemp has been decriminalized at the federal level and that the USDA has finally moved closer to approving state hemp plans under its to-be-published rules eliminates confusion for those in the hemp industry. But what is just as evident is that despite enhanced clarity on the federal level, whether industry participants will thrive or falter will hinge in part on navigating the complex network of fluctuating, often inconsistent state laws and regulations.
